% 24.09.2018 By order dated 03.08.2018, the Additional Sessions Judge while considering the bail application No.1069/2018 of the second respondent in the context of FIR No.173/2018 of Police Station Hauz Khas, involving offences punishable under Section 323/354/34 IPC found it a case justifying admitting the second respondent to anticipatory bail, questioning which decision the present application has been filed under Section 439(2) of the Code of Criminal Procedure, 1973.

Having regard to the facts and circumstances of the case, the dispute being between the two neighbours, presumably against the backdrop of the complainant having asked the other side to wait while they were asking her car to be removed from out of the way, the judicial discretion exercised by the court of Sessions admitting the second respondent to anticipatory bail does not call for any interference.

The petition and the application filed therewith are dismissed. R.K.GAUBA, J.
