After addressing arguments for some time, learned counsel for the appellant seeks leave to withdraw the present appeal directed against the order dated 6.3.2017 passed by the learned Principal Judge, Family Court (Central District), Tis Hazari Court, Delhi, granting pendente lite maintenance to his wife and minor child @ Rs.45,000/- p.m. and Rs.30,000/- p.m. respectively w.e.f. 28.11.2016 alongwith litigation expenses quantified at Rs.55,000/-.

Leave, as prayed for, is granted. As and when the appellant files an application before the learned Family Court seeking for modification of the impugned order, the same shall be considered and decided in accordance with law. However, it is clarified that if an execution petition has been filed by the respondent in the meantime, the same shall not be deferred merely MAT.APP.(F.C.) 120/2017 Page 1 of 2

because the appellant proposes to approach the Family Court for seeking modification of the impugned order, until the said order is so modified. 3.

The appeal is dismissed as withdrawn, along with the pending applications.
