W.P.(CRL) 2034/2016 Issue notice. Notice is accepted on behalf of the State and by respondent no.2. Respondent no.2 is present in person. She is identified by her counsel. This petition has been filed to seek the quashing of FIR No.676/2014 u/s. 498A/406/34 IPC against the petitioners on the complaint of respondent no.2 with PS Farsh Bazar, Delhi.
Petitioner no.1 and respondent no.2 were married on 14.07.2010. However, disputes arose between them which led to the registration of the aforesaid FIR against the petitioners. The parties have resolved their disputes in mediation vide settlement agreement dated 25.05.2015. They have already obtained divorce by mutual consent on 20.02.2016. Under the settlement, the petitioners undertook to make a payment of Rs.5.25 lacs to respondent no.2. Out of which Rs.4.25 lacs already stands paid. The petitioners had tendered a pay order for Rs.1.00 lacs towards the balance amount to respondent no.2 in court today, which is accepted by respondent no.2. Respondent no.2 states that she does not wish to pursue her complaint any further and joins the prayer for quashing the FIR and the proceedings arising therefrom.
In view of the above, no useful purpose would be served in keeping the FIR and the proceedings arising therefrom pending any further. Accordingly, the FIR stands quashed.
Petition stands disposed of.
