Crl.W.P. No.1328/2015 Heard the counsel for the parties.
The present petition is for quashing the FIR No.619/2015 (Hari Nagar Police Station) instituted for the offences under Section 420/ 467/468/471/34 of the IPC.
Learned counsel for petitioner submits that he being the landlord had filed a suit for eviction against the respondent before Civil Court. The fall out of such move was the institution of aforesaid FIR. However, with the intervention of the well wishers and on seeing logic and reason, parties settled their disputes. A compromise deed came to
be drafted on 13.05.2015, which is enclosed as Annexure P-2 to this application.
Pursuant to the compromise deed referred to above, an application was filed before the court below for passing a compromise decree. By order dated 28.05.2015 a compromise decree was passed. On these grounds the petitioners as well as respondents pray for quashing of the first information report.
Mr. Rajesh Mahajan, learned Additional Standing Counsel submits that this is a private dispute and such dispute having being resolved, he would not oppose the application for quashing of the first information report.
Taking these facts into account, FIR No.619/2015 and all other proceedings arising therefrom are hereby quashed. Petition is allowed and disposed of accordingly. Order dasti.
