% 04.09.2018 Learned counsel for the respondent nos.2 and 3 submits that Agreement to Sell dated 20/02/1973, filed along with written statement in CS (OS) 2083/2007 tilted 'Smt. Kasturi Rajan & Ors. Vs. M/s Prasad Process Pvt. Ltd. & Anr.', was taken back by the respondent nos. 2 and 3 with the permission of the court. It is submitted that the said Agreement to Sell has been lost.

Learned counsel for the petitioner disputes the fact that aforesaid Agreement to Sell has been lost. However, in view of the statement made by counsel for the respondent nos. 2 and 3 that Agreement to Sell dated

20/02/1973 has been taken back from the court file with the permission of the court, present petition has not been pressed and the same is disposed of accordingly.
