% 02.02.2016 Counsel for the petitioner states that the present writ petition is rendered infructuous as the petitioner had retired on 31st December, 2015. He, however, submits that the petitioner has challenged action of the respondents in issuing the charge sheet. He submits that the petitioner wants to rely upon certain pleadings including an affidavit filed by the respondents in these proceedings before the Tribunal, where he had challenged issuance of the charge sheet.

In view of the statement made, the writ petition is dismissed as infructuous. We, however, clarify that it is open to the parties to

rely upon the pleadings including the affidavits filed in this petition in accordance with the law.
