% 03.07.2018 After some hearing, the counsel for the petitioner submits that he has instructions to withdraw the present petition as the petitioner would like to appear before the investigating officer and, thereafter, if need be, apply for regular bail in the event of he being arrested. He, however, submits that pursuant to interim order passed earlier, an amount of Rs.10 Lakh had been deposited in this court and that liberty may be granted for he to claim the said amount to be refunded or appropriately applied at appropriate stage of the proceedings after completion of the investigation of the case. He submits that in order to ensure that the amount does not remain idle, it may be directed to be put in fixed deposit receipt so that it earns interest. BAIL APPLN. 2465/2016
It may be added that the complainant of the case has moved an application (Crl. M.A. 2470/2018) for release of the said amount of Rs.10 Lakh in his favour. The counsel for the complainant, who is also present, however, submits that the said application may be treated as withdrawn. It is dismissed accordingly. In above view, it is directed that the amount of Rs.10,00,000/- (Rupees Ten Lakh) deposited by the petitioner in terms of order dated 01.12.2016 in bail application 2465/2016 shall be put by the Registry in a fixed deposit receipt in a nationalized bank for a period of six months with provision for auto renewal till further orders. The said amount thus deposited will be dealt with, as per the directions of this court or of the trial court, as the case may be, on an application that may be moved by the petitioner or otherwise at appropriate stage as aforesaid.
The bail application no.2465/2016 is dismissed as withdrawn. The interim orders protecting the petitioner against arrest are hereby vacated. This disposes of all the pending applications. R.K.GAUBA, J JULY 03, 2018 yg BAIL APPLN. 2465/2016
