O R D E R
% 31.10.2017 The petitioner is aggrieved by order dated 21.04.2017 passed by the competent authority, whereby his prayer for being released on parole for preferring SLP before Supreme Court of India and for reconnecting social ties has been rejected primarily on the ground that the petitioner was found to have involved himself in other cases which are still pending. However, from the nominal roll, it appears that in the present case, the petitioner has been convicted under Section 364-A/368/344/347/120-B/34 of IPC and the maximum sentence which has been imposed upon him is life imprisonment under Section 364-A of IPC. For the other offences, he has been sentenced to imprisonment varying from 5 years to 3 years. The petitioner has remained in jail for about 10 years by now and has displayed satisfactory conduct in jail. It further appears that in other cases in which the petitioner has been convicted, he has already undergone the
sentences.
Mr. Sanjay Lao, learned Additional Standing Counsel, on the strength of the status report, submitted that the address of the petitioner has been verified and has been found to be existing at Firozabad in the State of U.P. Taking into account the period of confinement of the petitioner in jail and is having shown satisfactory conduct, this court is inclined to release the petitioner on parole for a period of four weeks. The petitioner is directed to be released on parole for a period of four weeks, to be counted from the date of his release, on his furnishing of bond in the sum of Rs. 5,000/- with one surety of like amount to the satisfaction of the Superintendent of the concerned jail. The petitioner shall, however, abide by the conditions listed below:- e) The petitioner shall surrender before the jail authorities on or before the end of the said period of parole.
f) The petitioner shall not engage himself in any unlawful activity. g) The petitioner would not leave the National Capital Region of Delhi, without intimating the officer-in-charge of the concerned police station.
h) He shall furnish his and his surety's mobile telephone numbers to the SHO of the concerned police station so that in case of necessity he could be tracked and his whereabouts could be ascertained. i) The petitioner shall get his presence marked twice a week preferably on Mondays and Fridays before the SHO of the concerned Police Station (New Ashok Nagar) in Delhi and in case he visits his home town, by the Officer-in-charge of PS Rasoolpur, Firozabad.
In case, the petitioner flouts any one of the conditions, an application could be moved by the SHO for cancellation of his parole and for taking of coercive steps for securing his attendance.
With these observations, the petition is disposed of. The order be communicated to the Superintendent of the concerned jail for compliance and record.
