O.M.P.(MISC.)(COMM.) 263/2018 This petition under Section 29A(4) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the „Act‟) has been filed by the petitioner seeking extension of time for making of the Arbitral Award by the Sole Arbitrator adjudicating the disputes that have arisen between the parties in relation to the Allotment Letter dated 12.02.2010 issued by the respondent in favour of the petitioner.
Learned counsel for the respondent, who appears on an advance notice, submits that the respondent has no objection if the time for making of the Award is extended, however, he submits that the Arbitrator is conducting the arbitration proceedings in the Chamber of the counsel for the petitioner in the High Court, against which the respondent has a grievance.
In my view, this grievance can be raised by the respondent before the Arbitrator himself.
Keeping in view the contents of the petition and the submissions made by the learned counsel for the respondent, the time for making of the Arbitral Award is extended by a further period of six months with effect from 04.09.2018.
The petition is allowed in the above terms with no order as to cost. Dasti.
