O R D E R

% 02.11.2017 In reply to a specific court query, the injured opposes the application for bail filed on behalf of the applicant, who is the elder brother of the injured, and submits that the petitioner has been assaulting the injured. It is inter alia submitted on behalf of the State that the petitioner did not join the investigation even in terms of the orders of the grant of interim bail by the learned ASJ, Saket Courts and the weapon of offence is yet to be recovered and it is also submitted that the applicant did not join the investigation after 25.5.2017.

In reply to a specific court query for production of the notice calling upon the petitioner to join the investigation, it is submitted on behalf of the State that the notice could not be served on the petitioner

after the date 25.5.2017. A copy of the MLC indicates that the simple injuries with blunt object had been caused to the injured. It is also submitted on behalf of the State in reply to another specific court query that there are no previous adverse antecedents against the petitioner as informed by the Investigating Officer. In view thereof, in the event of arrest, the applicant is allowed to be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the learned trial Court with the direction that the petitioner shall join the investigation of the case as and when required and shall not commit any further offence and shall not leave the city without any information to the SHO of the concerned police station. The petition is disposed of accordingly.
