This Revision Petition under Section 115 of the Code of Civil Procedure, 1908 (CPC) impugns the order dated 25th April, 2017 of the Additional District Judge (ADJ) of dismissal of applications filed by the petitioner/defendant for direction to the respondent/plaintiff to produce documents and for interrogatories and closing the right of the petitioner/defendant to file written statement. 2.

I have enquired from the counsel for the petitioner/defendant, as to how Revision Petition under Section 115 of CPC is maintainable. 3.

The counsel for the petitioner/defendant states that because there is a material irregularity in the impugned order, the Revision Petition under Section 115 is maintainable.

However attention of the counsel has been drawn to the proviso to sub-section (1) of Section 115 of CPC and it has been enquired, as to how the same is satisfied.

The counsel for the petitioner/defendant withdraws the petition with liberty to take appropriate remedies.

Dismissed as withdrawn with liberty aforesaid in accordance with law.
