O R D E R

After arguments, the appeal is prayed to be disposed of as not pressed and it is ordered accordingly, but the appellant, as prayed for, is granted time to vacate the suit premises on or before 31.12.2017, subject to the appellant clearing all arrears of mesne profits in terms of the trial court judgment and continue to pay the same month by month every month till the appellant is in possession of the suit premises. The appellant will also clear all charges towards electricity, water etc. as payable for the suit premises till the appellant remains in possession of the suit premises.

Appellant also undertakes to pay court fees as payable in this appeal positively within a period of three days from today.

Undertaking of the appellant to pay court fee is recorded through the appellant's counsel, who is appearing in court today. 3.

Let the appellant file the affidavit of undertaking in terms of the present order in this court within a period of one week from today and on filing the undertaking and complying with the terms of the same, the appellant will not be evicted from the suit premises till 31.12.2017.

The appeal is accordingly disposed of leaving the parties to bear their own costs.
