% 28.02.2019 The parties have settled the matter before the Delhi High Court Mediation and Conciliation Centre and have entered into a settlement agreement dated 21.02.2019.
The terms and conditions of the settlement agreement dated 21.02.2019 are legal and valid.
The settlement agreement is signed by the plaintiff and the defendant, who appear in person in court, and they confirm that they have signed the settlement agreement. The learned counsel for the parties and the learned mediator has also signed the settlement agreement. A decree is passed in terms of the settlement, which is contained in para 6 of the settlement agreement.
I may note that as per the terms of the settlement agreement, the three properties are to be sold and the proceeds to be distributed equally among the parties. It is agreed by both the parties in court that in case the sale is not
effected within the period stipulated in the settlement agreement, either of the parties is free to approach this court by filing an appropriate execution petition for sale of the three properties.
Binding the parties to the terms and conditions of the settlement agreement, the suit is disposed of. All pending applications, if any, are also disposed of.
