% 28.07.2017 CAVEAT No. 684/2017 Since counsel for the caveator has entered appearance, the caveat stands discharged.

C.M. Appl. No. 26628/2017 (for exemption) Exemption allowed, subject to all just exceptions. The application stands disposed of.

RSA 193/2017 and C.M. Appl. No. 26627/2017 (for stay) 1.

After arguments, this appeal is disposed of as not pressed, but the appellant, as prayed and agreed to by the respondent, is granted time to vacate the suit premises on or before 30.4.2018. Appellant in terms of the impugned judgment and decree will pay the admitted rate of rent at Rs.700/- per month till 31.7.2017 and thereafter will pay a sum of Rs.1,500/- every month by the fifteenth of each month till the RSA 193/2017

appellant stays in the suit premises on or before 30.4.2018. Appellant will also clear all charges as payable towards electricity, water, etc. for the use of the suit premises 2.

Let the appellant file an undertaking in terms of the present order in this Court within two weeks and on the appellant filing an undertaking and complying with the terms of the same the appellant will not be evicted from the suit premises till 30.4.2018. 3.

Parties are left to bear their own costs.
