% 14.12.2016 Matter has been taken up today as 12th December, 2016 was declared holiday on account of Milad-Un-Nabi (birthday of Prophet Mohammad). Petitioner no.1 and respondent no.2 are husband and wife. After resolving their disputes, they have started living together since August, 2016. Respondent no.2 is present in Court and has been identified by ASI Balu Ram PS Binda Pur. She submits that she has settled the matter with the petitioners and is living with petitioner no.1. She further submits that she is not willing to pursue the FIR any further. Keeping in mind that husband and wife have sorted out their differences and have started living together, no fruitful purpose would be served
to keep the criminal proceedings pending.
Accordingly, FIR No.1493/2015 under Sections 498A/406/34 IPC registered at police station Binda Pur, which is at the initial stage, is quashed.
Petition is disposed of in the above terms.
