% 03.08.2017 Crl.M.A. No.8903/2017 (for restoration) The present application seeks restoration of the leave petition that came to be dismissed by this Court by way of order dated 24th April, 2017, in view of the circumstance that there was no appearance on behalf of the petitioner.
Having heard the learned counsel appearing on behalf of the parties and particularly in view of the reasons stated in the application, we are of the view that it would be in the interest of justice to allow the present application.
The application is allowed.
The leave petition is restored to its original number.
CRL.L.P. 674/2016 In view of the circumstance that the State also has instituted a leave petition being Crl. L.P. No.669/2016, titled as 'State Vs. Sonu @ Monu & Ors.' against the order impugned in the present leave petition, the learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present leave petition with liberty to address the Court at the time when the said connected leave petition, instituted on behalf of the State, is heard. Leave and liberty granted.
