% 04.08.2017 Notice could not be issued to the respondent no.2 as process fee was not filed. However, respondent no.2 has appeared in Court today and has been identified by ASI Surender Singh of police station Nihal Vihar. Learned APP submits that injured Hunny has not been made party to this petition. Learned counsel for the petitioners makes an oral prayer for impleadment of Hunny as respondent no.3. Ordered accordingly. Amended memo of parties be filed during course of the day. Respondent no. 3-Hunny is also present in Court and has been identified by ASI Surender Singh.

It is submitted that petitioners and respondent nos. 2 and 3 have settled their disputes, therefore, FIR No. 47/17 under Sections 308/34 IPC registered at police station Nihal Vihar on the

complaint of respondent no.2 may be quashed.

Respondent nos. 2 and 3 submit that in the quarrel they sustained simple injuries. They further submit that they have now settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion. They have no objection in case the FIR is quashed.

Keeping in mind that a settlement has been arrived at between the petitioners and respondent nos. 2 and 3, inasmuch as, complainant has no objection in quashing of the FIR, in the interest of justice, FIR No. 47/17 under Sections 308/34 IPC registered at police station Nihal Vihar, which is at the investigation stage, is quashed.

Petition is disposed of in the above terms.
