% 04.08.2017 The only limited grievance which remains in the present petition is that a transfer certificate has not been issued by respondent No.3 (Birla Vidya Niketan). Contention is that the petitioner had been granted an admit card for his 12th class; he had appeared in the first examination but thereafter when he had gone for the second examination, his admit card was cancelled and he was not permitted to sit in the examination. Present petition seeks a prayer for compensation. The petitioner has been advised to take recourse to civil remedy for the said purpose. He accordingly does not press the said prayer in the present petition.

As noted supra, in the present petition what the petitioner is asking for his transfer certificate from respondent No.3. Respondent No.3 is represented. Respondent No.3 is directed to give transfer

certificate in order that the petitioner can pursue his studies in the National Institute of Open Schooling. Transfer certificate will be given to the petitioner within a period of 3 days. At this stage, learned counsel for respondent No.3 states that respondent No.3 school is also willing to re-admit the petitioner in 12th class in case he wishes to rejoin the school. If said offer is accepted by the petitioner, his total attendance will be counted from the date when he joins the school.

Petition disposed of.
