% 26.09.2018 Mr. Ankur Mishra, AR of respondent no.2 is present in Court and has been identified by SI Yogendra Kumar of police station EOW. Mr. Ankur Mishra submits that respondent no.2 has settled the matter with petitioners of its own free will and without any undue force, pressure or coercion and entire settled amount of `3.75 lakhs has already been received by it. He further says that respondent no.2 has no objection in case FIR No.120/2014 under section 103/104 of Trade Marks Act and section 63 of Copyright Act, registered at police station EOW and consequent proceedings emanating therefrom are quashed against the petitioners.
Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
