CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 18.09.2018 Respondent no. 2, Mr. Bhushan Mandal is present in Court along with his counsel and has been identified by SI Dinesh Kundu of police station Kamla Market. Respondent no. 2 says that he has settled the matter with the petitioners of his own free will, voluntarily and without any undue force, pressure or coercion vide compromise deed dated 30.07.2018. Petitioners have compensated the respondent no. 2 by paying ₹30,000/- to him. Respondent no. 2 says that he has no objection in case FIR no. 329/2017 under Sections 308/506/34 IPC registered at police station Kamla Market and the consequent proceedings emanating therefrom are quashed. Affidavit of respondent no. 2 in support of the petition is on record. Keeping in mind the settlement arrived at between the petitioners and
respondent no. 2, in my view no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
Dasti.
