Mr. Farooqui, the learned Additional Public Prosecutor, accepts notice on behalf of the State.
At joint request, the petition is taken up for disposal. A complaint was filed on behalf of the petitioner. The case has turned around inasmuch as he is now being treated as an accused. It is the
petitioner's case that he has handed over all the relevant documents to the police regarding the property in question. The learned counsel for the petitioner submits that petitioner's complaints have been pending for almost a year and worthwhile steps have not been taken. He submits that the petitioner is ready and willing to cooperate in the investigations in every way possible and has indeed done so. He submits that since the complaint primarily pertains to the right, title and interest in the suit property bearing No. 1897-1899, Shenshahi Building, Main Chandni Chowk, New Delhi, therefore, the lis would pertain primarily to documents, he would appear before the Investigating Officer in the present case or any other case as may be.
Mr. Farooqui, the learned Additional Public Prosecutor for the State, submits that the petitioner's arrest is not contemplated in the complaint filed by him.
In view of the above, it is expected that should the petitioner be required for any investigation or for production of documents or for custodial interrogation, due notice shall be given to him. The petition stands disposed-off in the above terms. NAJMI WAZIRI, J.
