W.P.(C) 5752/2017 This is a second round of litigation, earlier being W.P.(C) 2159/2017 which was disposed of by this Court on 10th March, 2017 with the following orders:

"1.

This writ petition is disposed of with liberty to the petitioner to file appropriate independent proceedings inasmuch as counsel for the respondent no.1/bank states that there is some issue with respect to entitlement of the petitioner being selected, inasmuch as, there may arise question of unfair means, but that aspect according to the counsel for the respondent no.1 is not clear today.

Accordingly, when the respondent no.1 takes a decision, and which decision is expected to be taken within a period of two months from today, respondent no.1 will inform the petitioner as to his selection or nonselection by means of a speaking order, and petitioner at that stage if is not held entitled to be appointed/selected, petitioner is at liberty to file appropriate independent proceedings.

3. Writ petition is accordingly disposed of with the aforesaid liberty."

Learned counsel appearing for the petitioner states that no order has been passed by the respondents till date.

Mr. Rajesh Kumar Gautam, learned counsel appearing for the respondents on advance notice states that case of the petitioner with 15 others was referred to the National Crime Record Bureau, New Delhi for its opinion and the opinion has been received on 7th July, 2017. He states that it is expected that the decision in terms of the order dated 10th March, 2017 shall be taken within two weeks from today and the same shall be communicated to the petitioner within one week thereafter. In view of the aforesaid submission / statement made by learned counsel for the respondents, learned counsel for the petitioner states that he would withdraw the petition and the petitioner if aggrieved by the decision to be taken by the respondents, he will challenge the said order. Ordered accordingly.

The petition is dismissed as withdrawn.
