CORAM:

HON'BLE MS. JUSTICE INDERMEET KAUR

O R D E R

% 20.12.2017 Petitioner seeks a correction in her name in the CBSE records; the petitioner is the mother of the Surpreet Singh Ahluwalia. It is pointed out that the name of the petitioner is Rajvinder Kaur Ahluwalia and not Raj Ahluwalia as has been reflected in the Class X Examination Certificate which had been issued by the CBSE to the petitioner's son.

The record of the school of the Venkateshwar International School has been produced in original before the court. The name of the petitioner has always been reflected as Rajvinder Kaur Ahluwalia. It appears that due to a mistake at the time of filling up of the form of Class X Examination, the name of the mother had been wrongly/typographically written as Raj Ahluwalia when her name actually is Rajvinder Kaur Ahluwalia.

The result of Surpreet Singh Ahluwalia had been declared on 28.05.2016. On seeing his result which reflected the name of the petitioner wrongly an application had been made to the school forthwith that is on 08.09.2016. Correction was not made as the CBSE had not co-operated. Present petition had accordingly been filed.

Rule 69.1(ii) of the Examinatio Bye-Laws of the CBSE permits a correction if it is made within the period of limitation; this court notes that the petitioner having forthwith moved the aforenoted application seeking correction in her name which is also reflected in the records of the school, the prayer made in the present petition needs to be allowed.

The prayer made in the petitioner is accordingly allowed and the name of the petitioner be read as Rajvinder Kaur Ahluwalia in the CBSE Class X Certified issued to Supreet Singh Ahluwalia and not Raj Ahluwalia. The petitioner will surrender original Class X Certificate of Surpreet Singh Ahluwalia to the CBSE which shall carry out necessary correction in the record within a period of 4 weeks from the date of receipt of the said certificate and the Class XII admit card will be issued in accordance with the corrected name. Petition disposed of in the above terms.
