This Revision Petition under Section 115 of the Code of Civil Procedure, 1908 (CPC) impugns the order dated 3rd July, 2017 [of the Additional District Judge-02 (West), Tis Hazari Courts, Delhi in CS NO.18/17/88 (Civ.DJ-12697/16)] of dismissal of an application filed by the petitioner/defendant under Order VII Rule 11 of CPC for rejection of plaint in a suit filed 28 years prior to the filing of the application and pending at the stage of respondent No.1/plaintiff‟s evidence. 4.
After some hearing, the counsel for the petitioner/defendant unconditionally withdraws the petition.

Dismissed as withdrawn.

Though the suit was pending, for most of the 28 years before this Court and has been transferred to the District Judge only now on change in pecuniary jurisdiction of this Court, it is still felt that the learned Additional District Judge (ADJ) before whom the suit is now pending should treat the subject suit on priority, giving precedence thereto over other suits / matters and endeavour to decide the same as early as possible. 7.
The learned ADJ is requested to endeavour to decide the suit before the winter vacation of the year 2017.

A copy of this order be immediately forwarded to the concerned ADJ. 9.
The counsel for the petitioner/defendant to also day after tomorrow when the suit is stated to be listed, communicate this order to the learned ADJ.
