% 11.07.2017 CM Appl. 10678/2017 Allowed, subject to all just exceptions.

Application is disposed of.

Bail Appln. 1302/2017 Learned senior counsel for the petitioner submits that petitioner has not been named in the FIR.

It is further submitted that main accusedBhupinder Singh, whose identity could be disclosed from the email portal, was declared P.O. on 16th March, 2017. FIR has been registered in the year 2013; whereas petitioner has been summoned for the first time on 11th June, 2017 on the pretext that he was also one of the directors of M/s click2resume.com. Complainant has alleged that he had enrolled himself for

a job with M/s click2resume.com. However, the company had fraudulently withdrawn `26,000/- from his account. Complainant has admitted that `17,746/- was returned by the company out of the Rs.26,000/- way back. Petitioner was merely an employee of M/s click2resume.com and later was made a director with 0.10% shareholding.

Learned APP has opposed the bail application. He has contended that during the investigation, it has been revealed that petitioner was one of the directors and authorised signatory, therefore, his custodial interrogation is required.

Keeping in mind the totality of the facts and circumstances, it is ordered that in the event of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of `20,000/- with one surety in the like amount to the satisfaction of the Investigating Officer/SHO/Arresting Officer of the concerned police station.

Bail application is disposed of in the above terms. Dasti.
