% 06.02.2017 The learned counsel for the respondent nos.10, 11 and 13 states that in case the third floor of the property bearing No.A-2/136, Safdarjung Enclave, New Delhi-110029 is transferred by way of sale or otherwise, the factum of pendency of the present litigation shall be mentioned in the instrument of transfer/conveyance. In view of the statement made by the learned counsel for the said respondents, the learned counsel for the appellant does not press this appeal any further inasmuch as his claimed 1/7th share in the said property has already been secured by the learned single Judge by way of a status quo dated 23.04.2013 in respect of balance property as also by the impugned order.
