% 12.01.2017 Despite service and pass-over of the case once, none has appeared for respondent Nos. 2 to 6. Accordingly, I proceed to dispose of the petition. The petitioner has preferred the present transfer petition under Section 407 Cr.P.C. to seek an order directing that FIR No. 439/2010 registered at police Station Anand Vihar titled as 'State Vs. Mahesh' under sections 325/341/34 IPC pending in the Court of Ms. Savitri, learned CMM (Shahdara), Karkardooma Courts, Delhi, and FIR No. 511/2010, registered at police station Anand Vihar (Crime Branch) new number 9091/2016 pending before the court of Shri N.K.Laka, CMM (East), Karkardooma Courts, Delhi, be transferred to one court in the interest of justice. Learned counsel for the petitioner submits that both the aforesaid

cases arise out of the same incident and transaction of 18.09.2010. Mr. Katyal, on instructions, state that it would be in the interest of justice that the aforesaid two cases are tried by the same Court. Accordingly, the case bearing FIR No. 511/2010, registered at police station Anand Vihar (Crime Branch) new number 9091/2016 pending before the court of Shri N.K.Laka, CMM (East), Karkardooma Courts, Delhi, is transferred to the Court of Ms. Savitri, learned CMM (Shahdara), Karkardooma Courts, Delhi, who is also hearing case FIR No. 439/2010 registered under Sections 325/341/34 IPC at police station Anand Vihar, Delhi, titled, 'State Vs. Mahesh'. The petition stands disposed of.
