W.P.(CRL) No. 3537/2016 Respondent no. 3 had financed the petitioner to enable him to purchase the vehicle. Disputes arose between the respondent no. 3 and the petitioner with regard to repayment of the financed amount, which led to registration of present FIR No. 322/2014 under Sections 420/406 IPC at Police Station Sangam Vihar on the complaint of respondent no. 3.

Petitioner and respondent no. 3 have settled their disputes vide a Compromise Deed. Petitioner has paid `4,00,000/- to the respondent no. 3, pursuant to the settlement.

Shri Krishan Kumar Sharma, Authorized Representative of respondent no. 3, M/s. Aggarwal Finance Company, is present in Court. He submits that matter has been settled by the respondent no. 3 with the petitioner without any undue force, coercion and pressure. He submits that respondent no. 3 is not willing to pursue the FIR any further, in view of the settlement arrived at between the parties. Keeping in mind the fact that disputes arose between petitioner and respondent no.3 in respect of repayment of financed amount, which has a civil flavour and that petitioner and respondent no. 3 have settled their disputes amicably, in the interest of justice, FIR No. 322/2014 under Sections 420/406 IPC registered at Police Station Sangam Vihar and the consequent proceedings emanating therefrom are quashed.
