O R D E R

% 09.01.2017 I.A. 201/2017 (O 23 R 3) The present application has been moved under Order 23 Rule 3 CPC for passing a decree in terms of the settlement deed which is annexed along with the application as Annexure-1. It is informed by the parties that the defendants had made a payment of Rs.10 lakhs in terms of the settlement deed.

In view of the present settlement, the suit stands decreed in terms of the settlement incorporated in Settlement Deed dated 16.12.2016 which is annexed along with the application as Annexure-1.

As per Section 16 read with Section 89 of the Court Fee Act, a certificate for refund of 50% of the Court fee shall be issued in favour of the plaintiff.

The next date, i.e., 03.03.2017 already fixed stands cancelled. Decree sheet be drawn accordingly.
