O R D E R

% 01.08.2017 Despite repeated call, there is no appearance on behalf of the petitioner. Learned counsel for the respondent, however, states that in view of the decision dated 13.07.2016, WP(C) 10756/2015, Bhuwan Chandra v. UOI & Ors, the petitioner is entitled to relief in terms of the paragraphs 11 and 12 and file is being processed in this regard. The respondents have failed to file the counter affidavit though the notice was issued vide order dated 21.12.2016. By the last order, we had imposed a cost of Rs.5,000/- on the respondents for failure to file counter affidavit.

As it is stated and accepted by the respondents that issue raised is covered by the decision of Bhuwan Chandra (supra), they would process the case and grant the relief which was granted in the case of Bhuwan Chandra (supra) within 12 weeks. In case the arrears are not paid within 12 weeks,

interest @ 8% per annum reckoned from 12 weeks from today will be paid. In the aforesaid circumstances, cost of Rs.5,000/- imposed vide order dated 01.05.2017 is waived.

With the aforesaid observation and direction, writ petition is disposed of .
