CONT.CAS(C) 471/2017 The respondent-Mr. R.O. Siddqui, Superintendant Engineer of the Delhi Development Authority is present in the Court. He states that the property in question was demolished inadvertently without awareness of the order of the Court dated 07.04.2016 passed in W.P.(C) 2307/2016. The Court had then directed maintenance of status quo with regard to the nature, title and possession of the subject land.

In this case, despite the order, the demolition of the building and construction upon the land i.e. Khasra No.389 (measuring 4235 sq. yds), being part of 11 Bigha situated in the revenue estate of village Malikpur chhavni, Delhi, was made on 07.04.2016. Having regard to the statement and the apology tendered by the respondent-Mr. R.O. Siddiqui, Superintendant Engineer, DDA, the Court is of the opinion that no further action needs to be taken. It is however open to the petitioner to seek consequential or other residuary orders, in the event, financial relief is granted in the pending writ petition (W.P.(C) 2307/2016), in which the claim that the lands are no longer subject to acquisition, has been asserted.
