O R D E R

% 11.08.2017 I.A. 9078/2017 in CS(OS) 1878/2015 Present joint application has been filed under Order 23 Rule 3 read with Section 151 CPC. The same is duly signed by the learned counsel for plaintiff and defendant as well as by the parties to the litigation. Present application is also supported by affidavits of an authorised representative of the plaintiff as well as the Director of the defendant. Both the learned counsel state that the matter has been compromised in accordance with the terms mentioned in the present joint compromise application.

Both the learned counsel further assure and undertake to this Court that the settlement terms mentioned in the present joint application shall be complied with.

The aforesaid statements, assurances and undertakings given by both the learned counsel are accepted by this Court and parties are held bound by the same.

This Court has also perused the compromise application and is of the opinion that the same is lawful.

Consequently, the suit is decreed in accordance with the I.A.9078/2017 dated 08th August, 2017 marked as Ex.C1. Registry is directed to prepare a decree sheet accordingly. With the aforesaid observations, present application is allowed and the suit and pending application stand disposed of. The interim order dated 06th July, 2015 is vacated.

The next date of hearing i.e. 30th August, 2017 stands cancelled. MANMOHAN, J AUGUST 11, 2017 js
