O R D E R
% 13.07.2017 This is a petition under Section 482 Cr.P.C filed on behalf of the petitioners for quashing of FIR No.960/2015, under Sections 323/452/308/354/354-B/34 IPC, registered at Police Station Kalyanpuri, Delhi and all subsequent proceedings arising therefrom. Learned counsel for the petitioners has submitted that the petitioners and the respondents No.2 to 4 are the neighbours and due to the misunderstanding, a dispute had arisen between the parties which resulted into the registration of the aforesaid FIR against the petitioners. Counsel
further submits that the petitioners got registered a cross-FIR bearing No.961/2015, under Sections 509/323/341/506/34 IPC at Police Station Kalyanpuri, Delhi against the respondents No.2 to 4 herein. Counsel further submits that after the registration of the FIR, the near relatives and the friends intervened and the matter has been amicably settled between the parties and the same has been reduced into writing vide settlement deed dated 05.07.2017 and nothing further remains to be adjudicated between the parties, however, the present FIR is coming as hurdle in the peaceful life of the parties and prays that the FIR and all proceedings arising of the same may be quashed.
The respondents No.2 to 4 are present in Court today and have been identified by the Investigating Officer ASI Vinod Kumar, P.S. Kalyanpuri, Delhi. The respondents No.2 to 4 are present in person and collectively admit that they have amicably settled the matter with the petitioners and nothing further remains to be adjudicated between them and the said settlement is voluntary and without any force, pressure or coercion and submit that the petitioners are their neighbours and they have no objection if the FIR is quashed.
Looking into the above facts and circumstances, since the matter has been amicably settled between the parties and the same has been reduced into writing vide settlement deed dated 05.07.2017 and nothing further remains to be adjudicated between the parties, to have peace in the neighbourhood and better relationship between the parties and to meet the ends of justice, I deem it appropriate to quash the FIR and all subsequent proceedings arising therefrom.
Consequently, FIR No.960/2015, under Sections
323/452/308/354/354-B/34 IPC, registered at Police Station Kalyanpuri, Delhi and all subsequent proceedings arising therefrom are hereby quashed. The present petition is allowed and stands disposed of accordingly. Copy of this order be given dasti to the parties, as prayed. I.S.MEHTA, J JULY 13, 2017 'dc'
