% 02.11.2017 It is stated that the parties have agreed to a mutually acceptable solution; the appellant management is willing to bear the fee and expenses payable to the learned counsel who may appear on behalf of the respondent/workmen.

Sh. Ravindera. S. Garia, learned counsel for the workmen submits that according to his instructions, the arrangement is acceptable.

After ascertaining the fee of the learned counsel representing the parties, the Court is of the opinion that the fee payable to the workmen's counsel ought to be Rs.5000/- per hearing; this fee

structure would apply irrespective of the fact that both references are clubbed or listed on the same date or heard on certain occasions separately, regardless of the number of hearings. A direction to that effect is accordingly issued to the appellant management to bear the expenses towards fee and counsel charges of respondents/workmen unions in the two references pending before the Industrial Tribunal. In view of these directions, learned counsel on behalf of the management is permitted to appear before the Industrial Tribunal in the pending industrial disputes in both the pending cases.
