By this petition, the petitioner seeks bail in case FIR No. 495/2014 under Sections 363/364A/302/201 IPC registered at PS Jamia Nagar. 2.

Learned counsel for the petitioner states that the petitioner is in custody since 11th July, 2014 and till date the trial has not concluded. Despite the learned Additional Sessions Judge having assured that best endeavour will be made to expedite the trial and fixing three dates in April, 2018 for examination of the witnesses but till date the trial has not completed.

Further status report has been filed. As per the said status report now only 8 witnesses of the prosecution remain to be examined, however, the BAIL APPLN. 1388/2017

said 8 witnesses are material for the reason the evidence against the petitioner is circumstantial in nature and these witnesses would deal with the said circumstances who would have to be cross-examined. 4.

Considering that the petitioner has been in custody for more than four years and the trial has not concluded though this Court is not inclined to grant bail to the petitioner at this stage, however, learned Trial Court is directed to expedite the trial and conclude the same preferably within a period of eight months from the next date of hearing before the learned Trial Court which is 23rd October, 2018.
