O R D E R

% 01.10.2015 Petitioner has challenged the order dated 5.5.2015 passed by the competent authority whereby the prayer of the petitioner for being released on parole for filing SLP before the Supreme Court of India and to reconnect and maintain social ties have been rejected.

The Police gave an adverse report and the competent authority was also of the view that the SLP could be filed from jail.

After verification, status report was filed by Ms. Kamna Vohra, Additional Standing Counsel.

Learned counsel for the petitioner has submitted that if released on parole, she shall reside with her elder brother, who is a permanent resident of Village Tayyabpur, PS Sikarpur, Bulandshehar, U.P. The petitioner appears to be a person of home and hearth.

She has a daughter who is married and stays with her husband.

The conduct of the petitioner in jail has been satisfactory.

Considering the fact that the petitioner is required to file SLP before the Supreme Court of India, this Court is inclined to release the petitioner on parole for a specified period.

The petitioner is directed to be released on parole for a period of 30 days on her furnishing a bond in the sum of Rs.10,000/- with one surety of like amount to the satisfaction of the Trial Court. The petitioner, on being released on parole, shall immediately furnish her mobile telephone number and mobile telephone number of her surety to the SHO of PS Shakkarpur. The aforesaid SHO would be informed of her tentative plan of going to her village home. After reaching her village home, the petitioner would be required to inform the SHO of PS Sikarpur in whose territorial jurisdiction Village Tayyabpur is situated. The SHO of the PS Sikarpur would be informed about the number of the days that the petitioner would stay with her elder brother.

The petitioner is required to surrender before the jail authorities on or before the expiry of period of parole.

The petitioner, needless to say, would not indulge in any unlawful activity.

With such observation, the petition is disposed of. A copy of this order be communicated to the Superintendent of the concerned Jail for information and compliance. Dasti.
