% 20.12.2016 The present petition has been filed by the petitioner with the following prayers:
"(a) Issue a writ of mandamus and direct the Respondent to convene meeting of the NCVT subcommittee forthwith and to consider the application of the petitioner for grant of affiliation for academic session 2016-2017; and (b) Consequently issue an appropriate writ, order or direction and permit the petitioner to admit students and commence the course for academic session 2016-2017; and (c) Pass any other and further order (s) as may be deemed fit." Learned counsel appearing for the respondent would submit that the case of the petitioner for affiliation was considered by the respondent in its meeting held on 15th December, 2016 and the affiliation has been granted to
the petitioner for the next academic session. She also states that the order granting affiliation shall be communicated to the petitioner within one week. Her statement is taken on record.
In so far as Prayer 'b' of the petition is concerned, same cannot be granted in view of the judgment of this Court in the cases being W.P.(C) No. 9444/2016, Samrat Ashok Private ITI v. Directorate General of Training (DGT) and W.P.(C) No. 9711/2016 Kalam Private ITI & Ors. v. Director General of Training (DGT) on 6th December, 2016. In view of the statement made by Ms. Meera Bhatia, Adv., Mr. Sanjay Sharawat, learned counsel for the petitioner seeks to withdraw the present petition.
The petition is dismissed as withdrawn.
