The petitioner seeks regular bail in case FIR No.88/10 under Sections 365/302/34 IPC registered at Police Station Sonia Vihar. Status report is on record.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. 3.

The petitioner is in custody since 19.11.2010. All the material prosecution witnesses have since been examined. It is informed that except PW-1 (Kanhiya Lal), all other material prosecution witnesses have turned hostile.

It is further informed that even in crossexamination PW-1 (Kanhiya Lal) did not support the case of the prosecution in its entirety.

Co-accused Umesh has since been granted regular bail by an order dated 9.6.2016. Similarly, co-accused Yogesh @ Kalli has been granted bail vide order dated 18.09.2013.

The petitioner was not named in the FIR and no specific role was assigned to him. Nothing was recovered at his instance.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of `50,000/-with one surety in the like amount to the satisfaction of the Trial Court.

The application stands disposed of.
