% 17.12.2018 On the last date of hearing learned counsel for plaintiff has stated that winding up order has been passed against the defendant company. Today none is present for the plaintiff.

The suit accordingly cannot proceed under section 446(1) of the Companies Act without prior permission of the Company Court. As no interest is being shown in pursuing the matter the suit is disposed of. Liberty is granted to the plaintiff to file a claim before the OL regarding its dues.
