O R D E R

% 29.01.2018 Learned counsel for the Respondent No. 1 submits that the Bank is willing to settle this matter, if the Appellant is willing to pay a sum of Rs.1,07,110/- for a full and final settlement of the disputes with the Appellant in this case.

This proposal is acceptable to the Appellant. Appellant is also present. He submits that he is willing to settle the dispute by paying the said amount. 3.

An amount of Rs.1,12,200/- has already been deposited in this court and the same has been kept in an Fixed Deposit Receipt in terms of the order dated 17th July, 2015.

It is directed that the Registrar General of this court may directly RFA 456/2015

release the amount of Rs.1,07,110/- in favour of the Respondent/Bank 'Punjab & Sind Bank, ARB-II, 91, Bhandhari House Nehru Place, New Delhi-110019'. The banking details are as under : A/c No. 0480110021887 IFSC: PSIB0000388 Branch: Nehru Place 5.

After remittance of the said amount, the remaining amount be released to the Appellant along with the interest that may have accrued on the said deposited amount. The impugned judgment and decree dated 30th March, 2015 is modified to this extent. Accordingly, the suit is decreed as having been settled between the parties.

The appeal is disposed of in the above terms. 7.

Relist this appeal before the Registrar General of this court on 12th February 2018 8.

The interim order dated 25th November, 2016 stands vacated. 9.

A copy of this order be given Dasti under the signature of the Court Master.
