W.P.(C) 5845/2017 and CM No. 24418/2017 Learned senior counsel for respondent submits on instructions that provisional bill which has been issued to the petitioner dated 01.02.2017 has been issued due to an oversight. Learned senior counsel for the respondent seeks permission of this court to withdraw this bill.
Learned senior counsel for the respondent points out that they
would be taking appropriate steps to issue an appropriate bill. The learned senior counsel for the petitioner points that in terms of the earlier order passed by the this court on 18.01.2017 in W.P(C) No. 484/2017, the respondent had been directed to raise a final Bill instead of a provisional bill. The bill should be in terms of the aforenoted order.
In this view of the matter, this petition has become infructuous. It is disposed of with all contentions of fact and law raised in the petition being left open to both the parties. Dasti under signatures of the Court Master.
