% 05.05.2017 Crl. M.A. No.3958/2017 This application has been preferred by respondent No.1 to seek recall of the order dated 25.08.2015 to the extent that the same directs initiation of suitable disciplinary proceedings against Mr. T. Kujur. Learned counsel for the respondent No.1 applicant submits that the

said officer Mr. T. Kujur has a history of suffering from serious psychological disorder. In this regard, the applicant has placed on record, inter alia, communication dated 26.06.2008 issued by the Additional Deputy Director in the Intelligence Bureau, Ministry of Home Affairs, Government of India to the Civil Surgeon, Dr. Ram Manohar Lohia Hospital, New Delhi, which refers to the medical examination of the said officer conducted in the year 2006. It appears that when he was examined in 2006, he was found fit to be continued in his duties. However, he was on medication. Keeping in view the conduct of the said officer taken note of in the orders passed by this Court and the fact that sufficient time has elapsed since the last review of the medical condition of Mr. T. Kujur, we allow this application. However, we direct that a fresh review of the psychological condition should be undertaken, and thereafter, appropriate steps shall be taken by the competent authority.
