O R D E R

% 21.01.2016 Order impugned order before this Court is the order dated 21.4.2015 vide which the permission sought by the plaintiff to confront D6W1 with a document i.e. a certificate from the Government Boys Senior Secondary School dated 28.3.2014 had been declined. The Trial Court was of the view that since this document had not been filed at the appropriate stage the defendant could not have taken the defendant by surprise and this document without it being a part of the record could not have been confronted to D6W1.

At this stage, learned senior counsel for the petitioner seeks permission of this Court to withdraw this petition to move an appropriate application before the Trial Court seeking permission to confront this document to D6W1. The Trial Court will decide such an application

dehors any observation made in this order.

Petition disposed of.
