O R D E R
% 19.02.2016 After some arguments, it has been agreed that the suit property i.e. shop measuring 11' x 11' situated on the ground floor of property No.1539, Ground Floor, Tota Ram Bazar, Tri Nagar, Delhi shall be vacated by the petitioner-tenant on or before 31.12.2016. Learned counsel for the petitioner has taken instructions from his client (present in Court) In this intervening the tenant-petitioner shall continue to pay user charges of Rs.327/- per month to the landlord-respondent. Arrears, if any, shall also be cleared within a period of one month from today. It is additionally made clear that at the time of handing over vacant and physical possession of the suit property back to the landlord all arrears of water and electricity charges shall be cleared by the tenant-petitioner. The property shall be free from all encumbrances. No third party interest shall be created in the suit
property.
All these facts shall be incorporated in an undertaking in the form of an affidavit to be furnished by the tenant-petitioner within a period of two week from today with advance copy to the landlordrespondent failing which the landlord-respondent shall be at liberty to execute the decree.
With these directions petition disposed of.
