1. The prayers in the present petition read as under: "a. pass a writ, order or direction in' the nature of a writ of declaration, declaring the acquisition proceedings initiated in respect ofthe land of the petitioner, admeasuring 2 bighas and 6 biswas bearing khasra no. 33//9, situated in Village Barwala, Tehsil Kanjhawala, Distt. North - West, Delhi, as deemed to have lapsed in view of the provisions of The Right to Fair Compensation and Transparency In Land Acquisition, Rehabilitation and Resettlement Act, 2013;
b. Further pass a writ, order or direction in the nature of a writ of mandamus thereby directing the respondents to pay the compensation as per The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013.
c. further pass order/direction to the respondents to handover the physical possession to the petitioner..
d. pass such ether or further orders as deem fit and proper in the circumstances of the case"
2. The narration in the petition is that notification under Section 4 of the Land Acquisition Act, 1984 (LAA) was issued on 21st March, 2003 followed by declaration under Section 6 of LAA issued on 19th March, 2004. The Award was passed on 1st August, 2005.
3. Learned counsel for the Petitioners seeks leave to withdraw the petition with liberty to file a fresh petition properly explaining the inordinate delay in approaching the Court for the above reliefs.
