% 05.12.2016 CM Appl. 45104/2016 (for exemption) in Cont.Cas(C) 1286/2016 Allowed, subject to just exceptions.

Cont.Cas(C) 1286/2016 & CM Appl. 45103/2016 Present contempt petition has been filed alleging wilful disobedience of the order dated 19th August, 2016 passed by this Court in W.P.(C) 4703/2016 whereby the principal amount was to be refunded within three days and the interest thereon was to be refunded within a period of six weeks.

Learned counsel for petitioner states that despite the aforesaid order, the interest amount has not been refunded till date. Issue notice.

Mr. Satyakam, learned counsel accepts notice on behalf of respondents. He, on instructions of respondent No.2 who is personally present in Court, states that the interest amount shall be refunded to the petitioner by ECS mode within a period of three days. In view of the aforesaid statement, present contempt petition and application stand disposed of.

In the event, the petitioner is aggrieved by the calculation of interest, petitioner is given liberty to file appropriate proceedings in accordance with law.
