After arguments, this appeal is not pressed and disposed of with the consent order that both the parties will not get more than three opportunities to complete their evidence by filing affidavits of evidence. In case, evidence by way of affidavits is not filed of the witnesses of the respective parties within three opportunities, evidence of such parties shall be deemed to be closed. Trial court is requested to ensure that the final arguments are completed within three months of completion of recording of evidence. 2.

The appeal is accordingly disposed of leaving the parties to bear their own costs.
