Petitioner was an employee of the respondent no.4, and which respondent no.4 is a private entity and not a State under Article 12 of the Constitution of India.

If therefore the petitioner has any grievance with respect to a particular quantum of pay which the petitioner as per him ought to have got and not a lesser pay, then, may be the petitioner may have a right, but that right will have to be exercised not by way of filing of a writ petition but by filing of a suit.

At this stage, petitioner states that petition be allowed to be W.P.(C) No.12129/2016

withdrawn with liberty to the petitioner to approach the Court of competent jurisdiction by filing of a suit, and accordingly the writ petition is allowed to be withdrawn with the aforesaid liberty.
