O R D E R

% 07.07.2015 The petitioner seeks quashing of the FIR No.226/2015 (Police Station Sarai Rohilla), instituted for the offences under Section 498/406/34 IPC. There had been matrimonial dispute between the petitioner and respondent no.2.

The marriage had taken place in the year 2012 but relationship deteriorated. A divorce petition was also filed by the petitioner. The present FIR was lodged by the respondent, after the divorce petition was filed. But, because of the intervention of the family members and the efforts of the Mediation Centre, the parties have agreed to live together and start afresh. An agreement has been entered into between the parties in which it is decided to withdraw all cases against each other and live as man and wife with love and affection.

The petitioner and the respondent are present in person in Court

today.

Ms. Nandita Rao, learned ASC, on instructions from the concerned police officer who has held the verification, identifies the parties to be the petitioner and the respondent.

Considering the fact that the case arose out of matrimonial dispute,. which dispute is no longer in existence, no useful purpose would be served in allowing the investigation to continue.

Learned counsel for the petitioner submits that the divorce petition which was filed by him has been withdrawn.

All litigations between the parties have ended. Considering this aspect of the matter, this Court is inclined to quash the FIR No.226/2015.

The FIR and all the resultant proceedings are hereby quashed. Petition is allowed and disposed off, accordingly. ASHUTOSH KUMAR, J JULY 07, 2015 ab
