Learned APP accepts notice for respondent no. 1. Respondent no.2-Smt. Gudiya is present in Court counsel and accepts notice. She has been identified by SI Sunil Yadav of police station Fatehpur Beri.
Petitioners and respondent no.2 were known to each other. A quarrel took place on some trivial issue which led to registration of FIR No.557/2015 under Sections 451/354/354B/509/323/34 IPC registered at police station Fatehpur Beri on the complaint of respondent no.2.
Respondent no.2 says that she has settled the matter with petitioners of her own free will and without any undue force, pressure or coercion vide Deed of Settlement/ Compromise Deed dated 7th
July, 2018 and in view thereof, she has no objection in case aforesaid FIR and consequent proceedings emanating therefrom are quashed against the petitioners.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the FIR pending. Accordingly, aforesaid FIR is quashed against the petitioners. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K.
